FTC Delays "Red
Flags" Rules Till June 2010
Near the
end of the day on Friday,
October 30th, the U.S. Federal
Trade Commission (FTC) announced
yet another last-minute delay of
the enforcement of its "Red
Flags" Rules. The new
enforcement date is now June 1,
2010.
This is the FTC's fourth delay
of the "Red Flags" Rule
enforcement date, and comes
after a judge for the Federal
District Court for the District
of Columbia ruled that the
agency cannot make the
regulations apply to lawyers.
Additionally, a bill recently
passed the House of
Representatives that would
exempt health care and
accounting practices, in
addition to law firms, and also
allow a broad section of other
businesses who meet certain
criteria to apply for an
exemption from the rules.
NACM has repeatedly covered the
FTC's "Red Flags" Rules in both
eNews and Business
Credit magazine. The
association has also sought to
assist business creditors with
compliance by hosting
teleconferences led by FTC staff
and legal experts, as well as by
offering a template for a "Red
Flags" program in Business
Credit and on its online
resource library.
